Tobique First Nation enacts its own prediction markets law

The First Nation has established a sovereign regulator and a new law that operates outside Canadian federal and provincial gambling legislation.

The Tobique First Nation in New Brunswick has enacted its own law to regulate prediction markets, creating a new sovereign authority separate from Canadian federal and provincial gambling legislation. The community of fewer than 3,000 people established the Tobique Prediction Market Authority under the new Prediction Markets Act. This makes Tobique the first and only Indigenous sovereign government in North America to launch dedicated prediction markets legislation. The law operates under the nation's inherent right to self-governance, as established by the Tobique Gaming Act of 2023.

The Tobique Prediction Markets Act bypasses Canadian federal and provincial laws that have historically placed heavy restrictions on short-term binary options. While not explicitly banning prediction markets, those restrictions have forced such markets into a grey area of operations. The new statute was enacted "pursuant to their rights of self-government," the First Nation said. It was passed "with the hope of promoting and preserving the reputation of the Tobique First Nation as an internationally credible jurisdiction for regulated Prediction Markets," the First Nation added.

The Tobique Prediction Market Authority will function as a separate entity from the existing Tobique Gaming Commission, which regulates gambling. The new authority will solely govern relevant permit holders. The Tobique Gaming Commission itself is a sovereign authority that operates outside of Canada's provincial and federal gambling legislation. It was established with the Tobique Gaming Act of 2023 and built upon the nation's inherent right to self-govern.

The First Nation has selected CL Specialist Projects Limited as its principal advisory partner regarding global market and business developments. Cliff Lewin, Director of CL Ltd, is the primary advisory contact. This development is distinct from typical coverage of prediction markets, as Tobique is essentially the first Indigenous sovereign government to launch such legislation in Canada and across North America. It remains to be seen whether Tobique will set a precedent for other First Nations to follow. Other states-within-the-state with Indigenous populations could move to set up their own prediction market frameworks, particularly in jurisdictions that have explicitly banned prediction markets.
